I've always heard people say 15 seconds, but don't quote me on that.

Any unapproved use of music that you don't have permission for constitutes infringement. Every artist handles this differently. I recommend getting music from a composer (like me) or downloading your music from royalty-free music libraries like AudioMicro. :)

The automatic system is from what I hear is 12 seconds, but copyright holders can still put in a claim. But as @Allegro1225 says if you don't hold the rights for the content then this is infringeing on a artists copyright rights, some artists don't mine and some are stritct. You better of using audio from royalty-free music libraries (Which Freedom! has a nice choice). like Position Music or AudioMicro or ask an artist directly themselves.

Actrually as far as I know it is, but it depends on which recording you used, sadly due to copyright laws being more iffy back then, then there are now I can't 100% say it is.

But it looks more like Sony own the rights to the 1967/68 recording, but like I say I not 100% sure on this.
